New legislation


On 12 October 2020, amendments within the Workers’ Compensation and Injury Management Amendment (COVID-19 Response) Act 2020 came into effect.


The amendments address a small number of priority issues in response to the COVID-19 pandemic:

  1. Establish a presumption of work-related injury for COVID-19 contracted by health care workers
  2. Discontinue the common law termination day
  3. Provide for a revised notice to be given to workers about common law claims
  4. Provide for email service of liability decision notices to workers from insurers and self-insurers
  5. Provide for annual indexation of capped worker entitlements

Workers’ Compensation NSW

SIRA enforces cover


According to a report from the State Insurance Regulatory Authority (SIRA) of New South Wales, 1,627 businesses took out a workers’ compensation policy between 1 July and 30 September after SIRA started its non-insurance investigations. As a result, 5,236 more employees are now covered by a policy.


SIRA also issued four penalty notices under s155 of the Workers’ Compensation Act 1987 for non-insurance, with each business fined a total of $750.


Workers’ pay clarified


The New South Wales Workers’ Compensation Amendment (COVID-19 Weekly Payment Compensation) Regulation 2020 came into effect on 23 October 2020. The new regulation aims to clarify how JobKeeper payments and other COVID-19 impacts on workers’ earnings are handled in calculating workers’ weekly payments and pre-injury average weekly earnings. It includes changes in the calculations of PIAWE and weekly payments.
